Billing Terms
Computer services/repairs are billed as stated on the service order or invoice provided.

There is a minimum charge of $35.00 for any house call made or any service performed.

Not all services can be completed on site and therefore, must be completed at our office, satellite offices and or home offices.

An estimate of cost for work will be provided before performing computer services/repairs. Estimates are not guaranteed.

In the case that there is an unforeseen deviation beyond the above estimated amount, every effort will be made to contact the customer and inform the customer of the situation and receive authorization to continue or stop at that estimate limit.  In the case that you cannot be reached, work will be stopped until contact is established. Once you are reached; your decision to continue or stop will be honored by Sams IT Tech.

All services/repairs are subject to California State Sales Tax.
 

Liability
Service(s) are provided in an effort to fix, upgrades, or otherwise repair the computer system(s) for which you request such service(s).
Your system will not be intentionally harmed. The primary goal is to fix your computer; not damage it.

In the case of accidental damage to your system, including data loss caused by already existing problems in your system such as a virus, poorly configured software, hardware problems or hardware failures; You agree to not hold Sams IT Tech responsible to any of these pre-existing problems.

It is your responsibility to backup your data. Sams IT Tech will not be responsible for data loss or any other damages. (see 1.4 above).
 

Support
Customer satisfaction is our utmost importance.

All Services will be conducted in a professional, reasonable, and timely manner. Also, taking into consideration the circumstances and nature of the technical problems.

Free support will be provided for problems to be resolved from the service ordered that were not resolved. After 30 days from the date on the invoice, Sams IT Tech will no longer offer free support.

Warranty work will only be covered if it is related to the work on the invoice. Unrelated work will not be covered by the warranty and may be charged accordingly.
 

Repairs & Service Guarantee
All services and repairs are guaranteed for 30 days from the date on the invoice or the Service Order.

If later found that the service or repair was incorrectly diagnosed by the technician; then Sams IT Tech will perform the repair/service free of any labor charge. Only parts will be charged if needed to correct the problem.
 

Indemnification
Client agrees to indemnify and hold Sams IT Tech harmless from all claims, losses, expenses, and/or fees including attorney fees, costs, and judgments that may be asserted against Sams IT Tech.
 

Estimates
Sams IT Tech offers free estimates over the phone or e-mail.

For in home/on-site estimates there will be a $35.00 fee. If you decide at that time you would like Sams IT Tech to work on your system, this fee will be waived and you will only be charged for the service being performed. (See 2.1 above).

If you decided at the time of the in home service call you would not like Sams IT Tech to fix your computer; you will be charged the $35.00 service fee and will have to pay for any additional services performed at that time.
 

Abandoned Property / Storage
Customer agrees to pick-up computer and pay for service s rendered within thirty (30) days of service completion.  If computer is not picked up within thirty (30) days a storage fee of $1 per day will be charged in addition to the original fee.

Equipment left behind, without returning our phone calls, voice-mail messages, emails and not picked up or paid for after 90 days will be considered abandoned by state law.  Hardware or material in the repair will be removed from your equipment.

If computer is not picked up within ninety (90) days it will be considered abandoned, according to California state law, and equipment will become property of Sams IT Tech and will be sold or recycled to recover damages and non-payment.
 

Entire Agreement
This Agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Agreement. This Agreement supersedes any prior written or oral agreements between the parties.
 

Governing Law
This Agreement shall be construed in accordance with the laws of the State of California.

Disclaimer
You agree to let Sams IT Tech, to fix your computer. Sams IT Tech will only perform and provide computer services, repairs and upgrades as requested by the customer. Sams IT Tech will conduct honest, reasonable and considerate services. Our goal is to provide the highest quality of service and support, but specific results cannot be guaranteed.

Computer Service/repairs are provided as a service. There may be circumstances under which you computer cannot be repaired. It will have to be rebuilt or upgraded. Examples: Age of PC, repair/replacement parts obsolete (RAM, Motherboards, etc.)
The length of time required to service/repair your computer cannot be predicted.

You understand that in the process of working on your computer equipment, there is a potential for data loss. You agree that you have made the necessary backups of your data so that, in the event of such loss, the data can be restored. Sams IT Tech will not be responsible for data loss nor will Sams IT Tech be responsible for restoring lost data. (See 4.4 below)

You authorize the technician(s) providing the service or repair to install anti-virus and any other necessary software on your computer to perform required services. All software will be deleted or uninstalled upon completion of the service (unless it was purchased).
All Remote Repair services are subject to the terms in this agreement.
